PAINT NIGHT – PARTICIPANT WAIVER, RELEASE & ASSUMPTION OF RISK
PLEASE READ CAREFULLY – BY SIGNING THIS DOCUMENT YOU ARE WAIVING LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
In consideration of being permitted to participate in this paint night, art workshop or related activity (the “Activity”), I acknowledge and agree as follows:
1. ASSUMPTION OF RISK
I understand that participation in the Activity involves risks and hazards, including, without limitation: exposure to oil paints, pigments, mineral spirits, solvents, cleaners, VOCs, odours and fumes, which may cause irritation, allergic reactions, headaches, nausea or other adverse reactions; accidental contact with, inhalation, ingestion or splashing of paints, solvents or other art materials; use of palette knives, brushes, easels, containers and other tools or equipment, including items with sharp edges; slips, trips and falls caused by easels, tables, chairs, cords, bags, supplies, spilled liquids, paint or other materials; chemical, solvent, water or paint spills and related exposure or injury; staining or damage to clothing, footwear, electronic devices or other personal property; and other risks associated with participating in an art workshop or being present in a working studio or event space.
2. RELEASE AND WAIVER
To the fullest extent permitted by law, I WAIVE, RELEASE AND FOREVER DISCHARGE WUB HOBBIES LIMITED, and their respective owners, directors, officers, employees, instructors, contractors, volunteers, representatives and agents, together with the owner, landlord, tenant and/or lessee of the premises where the Activity is conducted (collectively, the “Released Parties”), from any and all claims, demands, actions, damages, losses, costs or liabilities arising from or related to my participation in the Activity or presence on the premises.
THIS RELEASE INCLUDES CLAIMS ARISING FROM THE NEGLIGENCE OR GROSS NEGLIGENCE OF ANY RELEASED PARTY, including negligent supervision, instruction, maintenance, inspection or operation of the premises, equipment or Activity, to the fullest extent such claims may lawfully be waived.
3. PERSONAL RESPONSIBILITY & PROPERTY
I agree to follow reasonable safety instructions and use materials and equipment as directed. I understand that paints and solvents may permanently stain or damage clothing and personal property. I accept responsibility for protecting my belongings, and the Released Parties are not responsible for lost, stolen, stained or damaged personal property.
4. PHOTOGRAPHY & MEDIA CONSENT
By signing below, I consent to photographs and/or video being taken of me during the Activity and authorize WUB Hobbies Limited to use such photographs or video for its website, social media, advertising and other promotional or marketing purposes, without compensation to me.
If the opt-out box below is not ticked, I understand and agree that I have consented to the photography and media use described above.
5. PARTICIPANT CONDUCT & RIGHT TO REMOVE
I agree to conduct myself in a respectful and appropriate manner toward WUB Hobbies Limited, its owners, instructors, employees, contractors, volunteers, other participants and guests. Abusive, threatening, harassing, discriminatory, excessively disruptive, disrespectful or otherwise inappropriate behaviour will not be tolerated.
WUB Hobbies Limited and its instructors or representatives may, in their sole discretion, require any participant whose behaviour is considered inappropriate, rude, disruptive, threatening, harassing or abusive to leave the Activity or premises immediately. A participant who is removed from an Activity for misconduct will not be entitled to a refund, credit or other compensation for the Activity, regardless of the amount of time remaining in the Activity.
I understand that WUB Hobbies Limited may take reasonable steps to protect the safety, comfort and enjoyment of other participants, instructors and staff, including refusing or ending a participant’s participation where necessary.
6. ACKNOWLEDGEMENT
I confirm that I have read and understand this document, understand that it affects my legal rights, and sign it voluntarily.
